Create Your Own Fundraiser: Terms and Conditions
Last updated: 12th September 2026
Thank you for wanting to fundraise for Combat MSA. We rely on people like you to help fund research, raise awareness and support the community living with Multiple System Atrophy, and we're grateful you're willing to get involved. Before you set up your Fundraising Page, please take a few minutes to read through these Terms and Conditions.
These Terms and Conditions ("Terms") govern your use of the "Create Your Own Fundraiser" feature (the "Service") on the Combat MSA website (the "Site"). By creating a fundraising page ("Fundraising Page"), you ("you", "the Organiser") agree to be bound by these Terms. If you do not agree, do not use the Service.
Combat MSA is a trading name of Ezard Foundation, a registered charity (ABN 66 682 991 733) with the Australian Charities and Not-for-profits Commission, of Level 13, 664 Collins Street, Docklands, VIC 3008, Australia. References to "we", "us", "our" or "Combat MSA" mean Ezard Foundation trading as Combat MSA.
- Eligibility
1.1 You must be at least 18 years old to create a Fundraising Page. If you are under 18, a parent or guardian must create and be responsible for the page on your behalf.
1.2 You must provide accurate, current and complete information when setting up your Fundraising Page, including your name and contact details.
1.3 We may, at our discretion, refuse, suspend or remove any Fundraising Page, or decline any registration, without needing to give a reason.
- Purpose of Your Fundraising Page
2.1 Fundraising Pages must be created to raise funds in support of Combat MSA and its charitable purposes only.
2.2 You may not use the Service to raise funds for personal expenses, another organisation or cause, or any purpose unrelated to Combat MSA's mission.
2.3 You are responsible for the accuracy of all content on your Fundraising Page, including your fundraising story, target amount, images and any claims you make about how funds will be used. Content must not be false, misleading, defamatory, offensive or infringe anyone else's rights.
- Your Fundraising Page Content
3.1 We do not actively monitor every Fundraising Page, so please help us keep yours accurate and appropriate at all times.
3.2 Your Fundraising Page must not include:
- material that breaches or may breach the intellectual property rights of others, including content copied from other websites;
- images or footage of a person for whom you have not obtained consent to share their likeness;
- offensive material of any kind, including anything racist, sexist or not suitable for a general audience; or
- any other material that breaches the law, or that we consider inappropriate in our discretion.
3.3 We may remove any content from your Fundraising Page that we believe breaches these Terms, and may close your page altogether if we consider it necessary.
- Prohibited Conduct
You must not use the Service to:
- solicit donations under false pretences or misrepresent your connection with Combat MSA;
- harass, intimidate or pressure people into donating;
- use the Fundraising Page for commercial promotion unrelated to the fundraiser; or
- engage in any activity that breaches applicable Australian fundraising, consumer or privacy law.
We reserve the right to edit, suspend or remove any Fundraising Page or content that we reasonably believe breaches these Terms.
- Legal Compliance and Fundraising Laws
5.1 You are responsible for making sure your fundraising activity complies with all relevant Australian laws. Each state and territory has its own rules, so it is worth checking with your local council or state government before you begin.
5.2 If your fundraising activity involves serving alcohol, preparing or selling food, running a raffle or auction, or holding an event on public or council land, you may need a permit or licence. Please check with your local council or relevant state authority to find out what applies to your activity.
5.3 If you obtain any permits or licences for your fundraising activity, please send us a copy at info@combatmsa.org.au before your activity takes place.
5.4 If you are unsure what applies to your activity, tell us as much as you can about what you're planning when you set up your Fundraising Page, and we'll do our best to help point you in the right direction.
- Insurance and Risk Management
6.1 Your fundraising activity is not covered by Combat MSA’s insurance, including our public liability insurance. You should arrange your own insurance to cover your fundraising activity and everyone involved in it.
6.2 If your fundraising activity is being held at a venue, check with the venue directly, as their own insurance may cover the use of their premises.
6.3 Please take reasonable care to make sure that you, and anyone helping you, are fit and able to safely take part in your fundraising activity. If your activity involves physical exertion or any element of risk, we recommend seeking medical advice beforehand.
6.4 Please keep an eye on the weather and adjust your plans if extreme conditions could put you, your helpers or your supporters at risk.
- Public Statements
7.1 You must not make any statement, written or verbal, that could reasonably be understood as an official statement from Combat MSA or one of its representatives.
7.2 We're always happy to help with your promotion. We can provide messaging, images and other materials to support your fundraiser, and we're glad to review anything you'd like to share publicly before it goes out. Please let us know if any media, public figures or other promotional opportunities become involved in your fundraising activity.
7.3 If your fundraising is inspired by someone's personal experience of MSA and you would like to share that story publicly, please get that person's permission first, or their parent or guardian's if relevant. Everyone's experience of MSA is their own, and we ask that you respect their right to choose what is shared.
- Donations and Payment Processing
8.1 Donations made through your Fundraising Page are processed by our third-party payment provider, Stripe. We do not directly handle or store donors' payment card details.
8.2 All donations are made directly to Combat MSA, not to you personally. At no point do funds pass through your personal bank account.
8.3 Donors will receive an automated confirmation of their donation. Where the donation qualifies as a tax-deductible gift, an official receipt will be issued by Combat MSA directly to the donor; Organisers cannot issue their own receipts.
8.4 Stripe's standard processing fees (plus any applicable card surcharge) may be deducted from each donation before it reaches Combat MSA. These fees go to Stripe, not to us, and are set out in Stripe's current pricing for Australia.
- Fundraising Targets, Timeframes and Use of Funds
9.1 Any fundraising target you set is a goal only. There is no guarantee it will be reached, and we are not liable if it is not.
9.2 All funds raised through your Fundraising Page belong to Combat MSA and will be applied to our general charitable programs unless we have separately agreed in writing to a specific restricted use.
9.3 We may set a minimum or maximum duration for Fundraising Pages and may close a page at any time, including after its end date.
- Content and Intellectual Property
10.1 You retain ownership of any original content (photos, text, video) you upload, but you grant Combat MSA a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content on our Site and in our marketing, both during and after your fundraiser, for the purpose of promoting the fundraiser and our work.
10.2 You must only upload content you have the right to use, and must not use our logo, branding or trademarks except as provided through the Service's official templates.
- Privacy
We collect and handle personal information you and your donors provide in accordance with our [Privacy Policy]. By using the Service, you consent to that handling, including sharing relevant donor details with our payment processor solely to process donations.
- Verification and Our Right to Act
12.1 We may verify your identity and the legitimacy of your Fundraising Page at any time.
12.2 We may suspend, edit or permanently remove a Fundraising Page, and withhold or reverse any associated funds, if we reasonably suspect fraud, misuse, or a breach of these Terms.
- Liability and Indemnity
13.1 The Service is provided "as is". To the maximum extent permitted by law, Combat MSA is not liable for any loss, damage or costs arising from your use of the Service, including technical failures, third-party payment processing issues, or the actions of donors or other users.
13.2 You indemnify Combat MSA against any claims, losses or damages arising from your Fundraising Page content, your breach of these Terms, or your breach of any law.
13.3 Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.
- Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms.
- Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
- Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria.
